Vaping Awareness: What Parents Need to Know
The health, safety, and well-being of our scholars remain a top priority. Parents and guardians are encouraged to talk with their scholars about the risks of vaping, particularly as state laws have increased the consequences for possession and use of vape products.
Texas law requires school districts to take specific disciplinary action when students are found possessing, using, selling, or distributing e-cigarettes or vape products on school property or at school-related events.
Under House Bill 114, scholars found in violation must be assigned to the Kathy Goad Center, DeSoto ISD's alternative education program. This law removes district-level discretion and establishes a statewide standard for addressing vaping offenses. Vaping violations are now treated with the same level of seriousness as alcohol- and drug-related offenses to promote consistency and discourage use among students.
Parents should also be aware that vape products, especially those containing high-potency THC, can pose serious health risks and may contain harmful or unknown substances. Additionally, Senate Bill 3 makes the possession, manufacture, or sale of THC-containing hemp products, including delta-8 and delta-9 vape products, a criminal offense in Texas. Depending on the circumstances, scholars may face both school disciplinary consequences and criminal penalties.
Law enforcement involvement may vary based on a scholar's age and the nature of the offense:
- Scholars 17 years of age and older may be subject to arrest and processing by law enforcement.
- Scholars ages 14–16 may be detained and released to a parent or guardian following juvenile processing procedures.
- Scholars ages 10–13 may be held pending parent notification and referred for appropriate legal action.
While not required by law, DeSoto ISD may provide educational and counseling support to help scholars understand the dangers of vaping and make healthier choices moving forward.
